Website Copyright: All websites are created “from scratch,” and any similarity to existing works is coincidental. In cases where clients request that their site look exactly like an existing site, the developer will attempt to persuade the client to allow changes. If the client cannot be persuaded, they may be required to sign a waiver freeing XDude from any legal liability.
Item Copyright: If a client supplies XDude with images, sounds or videos for use on their website, XDude will not be held liable if those items are found to be copyrighted by a third party.
Source Files: Source files are the intellectual property of the developer and as such are very rarely included with a site's development (if you don't believe me, ask around!). However, clients will be provided with editable image headers and directions on where to purchase the fonts necessary to make minor updates and changes to their sites.
Payment: All projects will be paid on a schedule of thirds: 1/3rd is due before the project starts, 1/3rd is due before the final draft begins, and 1/3rd is due upon delivery of the final product.
Customer Satisfaction Guarantee: XDude provides a conditional money-back guarantee. Full refunds will be issued if no work has been done on a client’s project; in the cases where work has been done and the customer wishes a refund, the “1/3rd upfront” portion will not be refunded. To minimize the risk of disagreement between the client and the developer, full legal contracts are issued, customized to the needs of each client, before any work begins on the client’s project. Complete detail breakdowns of the work to be performed will be provided, to ensure that the expectations of both the client and the developer are synchronized. A complete breakdown of the payment schedule and refund policy will be included.
